TITLE:Award CDBG-DR Funds for Public Facilities and Infrastructure Projects 

I.MOTION REQUESTED
 
A. Award public facilities and infrastructure grants to the 20 proposals recommended for funding by the Public Facilities and Infrastructure Evaluation Committee as referenced in the attached document. 

 

B. Authorize Board Chair, on behalf of the Board, to execute subrecipient agreements for awarded CDBG-DR public facilities and infrastructure projects.

 

C. Authorize the County Manager or designee to execute memorandums of agreement for projects being undertaken by Lee County departments. 

 

D. Authorize the County Manager or designee to execute any amendments or change orders to CDBG-DR written agreements in accordance with CDBG-DR policies and procedures. 

 

E. Direct staff to prepare CDBG-DR waiver and alternative requirement requests to allow greater flexibility concerning the use of remaining HUD Hurricane Ian recovery grant funds for the Board to consider at a future date.

 
II.ITEM SUMMARY
 Funds $229,155,755 of public facility and infrastructure projects using Lee County's Hurricane Ian CDBG-DR allocation. Twenty projects will be undertaken by the County, each municipality, the school district, LCEC and nonprofit entities that are associated with governmental sponsors. The CDBG-DR Public Facilities and Critical Infrastructure Evaluation Committee recommended these projects unanimously.
III.BACKGROUND AND IMPLICATIONS OF ACTION

The U.S. Department of Housing and Urban Development (HUD) announced that Lee County will receive $1,107,881,000 in funding to support long-term recovery efforts following Hurricane Ian (FEMA – 4673 – DR) through the Office of Disaster Recovery (ODR) within the Office of Community Planning and Development. Community Development Block Grant-Disaster Recovery (CDBG-DR) funding is designed to address needs that remain after all other assistance has been exhausted. Program rules are detailed in 88 FR 32046 (May 18, 2023) and other relevant federal statutes and regulations.  In accordance with Federal Register Notice 88 FR 32046 and as approved by the Board of County Commissioners, Lee County submitted the Action Plan for Community Development Block Grant – Disaster Recovery (CDBG-DR) funds on September 19, 2023. HUD approved the Action Plan on November 7, 2023. 
 
The BoCC authorized the launch of the CDBG-DR Critical Infrastructure and Public Facilities Programs on March 5, 2024.

Lee County’s Office of Strategic Resources and Government Affairs submitted Lee County’s Action Plan for CDBG-DR funds to HUD on September 19, 2023, which HUD approved on November 7, 2023.  The Action Plan identifies several programs to address unmet recovery needs resulting from Hurricane Ian. 

 

Lee County has allocated $229,155,755 in CDBG-DR funding for critical infrastructure and public facilities activities to be undertaken by units of general local government. The request for funds was made available to Lee County and its six municipalities. For both NOFAs, local governments could partner with non-profit organizations, special districts or utility providers to carry out eligible activities.

 

The BoCC authorized the launch of the NOFAs on March 5, 2024. Eligible applicants submitted their applications prior to the deadline on May 24, 2024. Threshold reviews were completed to identify the applications that met the program requirements. The applications were then reviewed and scored according to the rubric included in the NOFAs.

 

The Public Facilities and Infrastructure Evaluation Committee met on August 12, 2024, to evaluate the applicants’ proposals, and recommended 20 projects for funding. Projects recommendations were made based on the following factors: limited availability of mitigation funding, timelessness and urgency of projects, leveraged funding sources, and geographic distribution of funds based on need demonstrated by FEMA Public Assistance Funding Requests, FEMA Individual Assistance, and share of low-and-moderate income populations. Tables showing those needs are included below:

The tables below depict the funding awards recommended by staff and the CDBG-DR Infrastructure Evaluation Committee on August 12, 2024. In addition, the committee recommends that the Board of County Commissioners request HUD to waive its requirement that 70% of CDBG-DR funds for Hurricane Ian be used to benefit low- to moderate-income (LMI) persons; request a Buildings for the General Conduct of Government Waiver and Alternative Requirement; and consider projects deemed eligible under the current NOFAs, but not awarded, for future funding should it become available.

Written agreements will be executed by subrecipients and routed for BoCC signature as soon as possible. 

 

SRGA staff and contracted program implementation vendors will oversee funded projects throughout the agreement terms.

 The Board Chair may need to approve any future amendments to the contracts, for this and previous fiscal years, in accordance with CDBG-DR policies and procedures.
