TITLE:Approve Amendment to Lease with University of Florida for Property on Pineland Road 

I.MOTION REQUESTED
 A) Approve First Amendment to the Lease dated January 9, 2001 between the County and the University of Florida pertaining to property at 7450 Pineland Road in Pineland;
B) Authorize the acceptance of $102,617.72 from the University pursuant to the Amendment;
C) Authorize Chair to execute the Amendment on behalf of the Board; and
D) Authorize the Department of County Lands to handle all documentation necessary to complete the transaction.
II.ITEM SUMMARY
 Amends a lease agreement with the University of Florida for property located at 7450 Pineland Road. This property includes a building the University subleased to the United States Postal Service (USPS), which was damaged by Hurricane Ian.  The University maintained property insurance for the building and received $102,617.72 for the damage, which will be assigned to Lee County.  The building will be removed from the lease and the County will use the insurance funds to repair the damage.  The County anticipates entering into a new lease with the USPS for the building so that the post office can reopen once repairs are completed.

  Pursuant to a Lease Agreement dated January 9, 2001, the County leased property at 7450 Pineland Road in Pineland to the University of Florida, including the historic Ruby Gill House and an adjacent building previously subleased by the University to the United States Postal Service. No base rent is payable under the Lease. Under the Lease, the University is responsible for the maintenance and repair of both buildings. The post office building was damaged by Hurricane Ian, at which time the USPS closed the post office to the public. The University has received insurance proceeds of $102,617.72 for damage to the post office building. The sublease between the University and the USPS has since expired, on September 30, 2023. In lieu of the University repairing the damage to the post office building, pursuant to the First Amendment, (i) the post office building will be removed from the Lease, (ii) the University will assign the $102,617.72 insurance proceeds to the County, and (iii) the County will accept responsibility for repairing damage to the post office building. The County currently anticipates entering into a new lease with the USPS for the post office building so that the post office can reopen once repairs are completed.
