| | | | | | | | | I. | MOTION REQUESTED | | | A) Accept the donation of a temporary parking area from Fort Myers Beach Fire Control District for overnight parking of three Lee Tran trams, located at 2545 and 2555 Estero Boulevard, Fort Myers Beach. The term of the parking agreement runs from November 1, 2023 through May 1, 2024. There is no consideration required to utilize the space.
B) Authorize Chair to execute the License Agreement on behalf of the Board.
C) Authorize County Lands to handle all documentation necessary to complete the transaction. |

| | | | | | | | | II. | ITEM SUMMARY | | | Approves a permissive use license agreement to accept the donation of a temporary parking area from Fort Myers Beach Fire Control District. The area, located at 2545 and 2555 Estero Boulevard, Fort Myers Beach, will be used for overnight parking of three LeeTran trams. The term of the agreement is November 1, 2023 through May 1, 2024. Lee County is responsible for installing fencing along the Estero Boulevard side of the area and responsible for removing the fencing and restoring the site once the agreement expires. |

| | | | | | | | | | D) | Analysis | | | | This donation is for a License Agreement between Fort Myers Beach Fire Control District and Lee County for overnight parking of three Lee Tran trams, located at 2545 and 2555 Estero Boulevard, Fort Myers Beach.
There is no consideration required to utilize the space. Lee County is responsible for installing fencing along the Estero Blvd. side of the site area. Upon expiration of the License Agreement, Lee County is responsible for removing the fencing and restoring the Site Area to as good or better condition than that which existed prior to its use.
The term of this License Agreement is from November 1, 2023 through May 1, 2024. The License Agreement can be terminated by either party with no less than ninety (90) days’ prior written notice. |
