| | | | | | | | | II. | ITEM SUMMARY | | | This item approves an Interlocal Agreement between County and the School Board of Lee County for the use of School District facilities as emergency shelters. This agreement supersedes the Interlocal dated November 6, 2018. The Interlocal Agreement outlines the legal responsibilities of each entity and outlines the financial arrangement between the entities, including the responsibility of the County to act as the FEMA Public Assistance Applicant for the District's costs for emergency sheltering activities. The agreement is scheduled to be heard by the School Board at the meeting on November 7, 2023. |

| | | | | | | | | | A) | Board Action and Other History | | | | Section 252.38, Florida Statutes, allows Counties to utilize local school facilities to support emergency sheltering operations. This is the primary strategy used across the state, and within Lee County under an Interlocal Agreement with the School Board of Lee County. Recently, the Florida Division of Emergency Management advised Counties that the responsibility for certain actions, while permissible under Florida Statutes, should be conducted under an Interlocal Agreement and compensation for these activities should be from the County to the District, with the County acting as the Public Assistance applicant.
The last update to this agreement occurred on November 6, 2018. This update included changes brought upon by Hurricane Irma in 2017. Before Hurricane Ian, the School District asked the County to renegotiate the Interlocal to stipulate further terms and conditions of the relationship and responsibilities for payment of the costs of sheltering during a State of Local Emergency.
Representatives from the County and the District met in May to discuss the requested modifications and changes. The parties agreed in principle and finalized a draft in June. The agreement is scheduled to be heard by the School Board at the meeting on November 7, 2023.
The primary changes to the agreement are the responsibilities of each party during emergency sheltering operations, the consideration for an outside vendor to provide staffing support on behalf of the County during emergencies, the timing of invoicing and payments, and what costs will be the responsibility of each party. The agreement also strengthens liability protections for the parties individually and collectively. |
