| | | | | | | | II. | ITEM SUMMARY | | Execute an interlocal agreement with the East Mulloch Water Control District (EMWCD) to allow Lee County to maintain the District’s surface water management systems on behalf of the District. Costs for maintenance activities will be funded by the EMWCD’s annual assessment, with work plans and budgets approved on an annual basis by the EMWCD. |

| | | | | | | | | A) | Board Action and Other History | | | The East Mulloch Drainage District was first created in 1963 as an independent special district under chapter 298, F.S. The district was responsible for maintaining canals, water retention ponds, and drainage structures in an area of approximately 3,000 acres, primarily an area known as San Carlos Park. Over the years, the Florida Legislature modified aspects of the District boundary.
In 2018, the Florida Legislature adopted legislation making the East Mulloch Water Control District (EMWCD) a Ch. 189, F.S., dependent special district of Lee County. Ordinances 19-11 and 19-15 were subsequently approved by the Lee County Board of County Commissioners to best assist the EMWCD in maintaining its canals, water retention ponds, and drainage structures within the boundaries of the EMWCD.
On January 17, 2020, the EMWCD Board of Supervisors voted unanimously to approve an interlocal agreement with Lee County to enable Lee County staff and/or contractors to perform all required maintenance activities on the EMWCD's canals, water retention ponds, and drainage structures.
