TITLE:	Approve Bald Eagle Mangement Plan for 5081 Pine Island Rd NW, Bokeelia

I.	MOTION REQUESTED
	Approve a Bald Eagle Management Plan associated with new construction on property located at 5081 Pine Island Road NW, Bokeelia, which is within 660 feet of bald eagle nest LE-081.

ITEM SUMMARY

Approve a Bald Eagle Management Plan for bald eagle nest LE-081 in conjuction with new construction of a gas station and convenience store at 5081 Pine Island Road NW, Bokeelia, which is within 660 feet of the bald eagle nest. The Bald Eagle Management Plan proposes exterior construction within 660 feet of the bald eagle nest to occur during the non-nesting season (May 16-September 30). Board approval of the Bald Eagle Management Plan is required under the County’s Eagle Protection Ordinance; approval is recommended by the Eagle Technical Advisory Committee.

BACKGROUND AND IMPLICATIONS OF ACTION

	A)	Board Action and Other History
		The bald eagle nest, LE-081, is located on property adjacent to 5081 Pine Island Road NW, Bokeelia. It is an active nest where one chick was fledged during the 2018-2019 nesting season. The Bald Eagle Management Plan is triggered by proposed construction of a new gas station and convenience store within 660 feet of the nest. The 660-foot radius is a requirement of the County’s Eagle Protection Ordinance.

		To avoid disturbance of the bald eagle nest and nesting activity, the Bald Eagle Management Plan proposes to limit exterior construction to the non-nesting season. On November 12, 2019, the Eagle Technical Advisory Committee recommended 3-0 to approve the proposed Bald Eagle Management Plan. Staff also recommends approval of the proposed Bald Eagle Management Plan.
