TITLE:Approve Petition to Vacate at 1909/1911 and 2001/2003 Park Rd, Lehigh Acres, FL 

I.MOTION REQUESTED
 Case No. VAC2019-00005 Conduct a public hearing to adopt a resolution to approve the vacation of two platted lots in their entirety, Lots 41 and 42, Block 13, as shown on the Plat of Unit 3 Lehigh Park, A Subdivision of Lehigh Acres, as recorded in Plat Book 15, Page 66 of the Public Records of Lee County, Florida and upon the successful vacation of the two platted lots authorize a new replacement public utility easement. (STRAP # 21-44-26-03-00013.0410/.0420)
II.ITEM SUMMARY
 Vacation of that portion of the Plat of Unit 3 Lehigh Park located at 1909/1911 and 2001/2003 Park Road in Lehigh Acres, reverting said property back into acreage and removing all public rights so as to be able to utilize the resulting single lot of record in conjunction with the adjacent runway for operation and maintenance of the Lee County Mosquito Control District’s facilities.

  The completed petition to vacate, VAC2019-00005, was submitted by Dave Johnston on behalf of the Lee County Mosquito Control District who proposes to utilize the lots in conjunction with the adjacent runway for operation and maintenance of the Lee County Mosquito Control District’s facilities.
The approved resolution will serve to vacate the described portion of the plat, returning said described property covered by the plat into acreage.
Staff has reviewed the Petition to Vacate (VAC2019-00005) together with letters of no objection from public utility providers.
Pursuant to AC13-1 (D.2.d) Letters of review and recommendation from required entities have been received and offer no objection to the vacation.
Pursuant to AC13-1 (D.2.i), applicant has provided proof that all affected property owners were given the required notice describing the proposed vacation.
An executed replacement public utility easement is being held in trust, to be recorded upon approval and recording of the resolution granting vacation per VAC2019-00005.
The vacation of the portion of the plat will not alter existing drainage or utility conditions, it will not affect the ownership or right of convenient access of persons owning other parts of the subdivision.
Approval of this vacation does not relieve the applicant from obtaining necessary permits for improvements/ development.
The proposed new access road (reason stated for vacation) would be permitted within the current zoning classification (CF).
