Section 3 of Lee County Ordinance 92-22 prohibits solicitation of a professional services firm to perform project design and/or construction services if the firm has or had been retained to perform the project feasibility planning or analysis. The Ordinance was adopted by the Board of County Commissioners in 1992 and incorporated in the procedures to select professional services for planning or study activities.
Adopted September 18, 2018, Procurement Ordinance 18-22 also prohibits professional services from firms retained to perform the project feasibility planning or study analysis for the same project.
Waiving these abovementioned sections of Lee County Ordinances 92-22 and 18-22 allows the County to solicit for one firm to perform a Project Development and Environment (PD&E) study and prepare design documents for the Alico Connector project. The aim of this project is to construct an extension of Alico Road from Airport Haul Road to State Road 82.
This is beneficial to the County because it allows the Department of Transportation to adopt the Florida Department of Transportations’ State-Wide Acceleration Transformation (SWAT) process to streamline the planning, project management, and procurement of the PD&E and Design phases of this project, resulting in both a time and cost savings for the citizens of Lee County.
Additionally, the waiver of these sections of ordinances will allow firms that participated in the 2009 Alico Connector Alternate Study to submit proposals for the Alico Connector PD&E and Design project. This benefits the County by increasing the pool of knowledgeable and qualified firms to submit proposals for this project.
