TITLE:Amendments to Administrative Code AC-7-10 (Derelict & Abandoned Vessel Removal Program) 

I.MOTION REQUESTED
 Adopt a Resolution amending Administrative Code AC-7-10 (Derelict & Abandoned Vessel Removal Program)
II.ITEM SUMMARY
 The Resolution will amend the current Administrative Code to add an appeal process, redefine the vessel type removal prioritization and make other minor changes/updates to the provisions contained in the code.
III.BACKGROUND AND IMPLICATIONS OF ACTION
 A)Board Action and Other History
  AC-7-10 was first adopted in May of 2004, and amended in December of 2006. It was adopted to facilitate the removal of derelict and abandoned vessels in the County’s waterways. Removal may be by either the County’s Division of Natural Resources or by any Authorized Public Entity pursuant to Florida Statutes §§ 376.15(3)(a) and 823.11.
 B)Policy Issues
  Amendment is necessary to continue efficient and effective removal of derelict and abandoned vessels.
 C)BoCC Goals
  Afford appropriate due process considerations and improve safety in the County’s waterways.
 D)Analysis
  Amendment of the code will utilize the existing jurisdiction of the Lee County Hearing Examiner to afford an appeal pursuant to the requirements of due process. Revise the vessel type removal prioritization for efficient and effective characterization of derelict and abandoned vessels.
 E)Options
  Approval is necessary to afford due process to the Code and update the vessel type removal prioritization.
