1. Approve granting a subordination of utility easement interests to the Florida Department of Transportation for roadway improvements at the northwest corner of Colonial Boulevard and Ortiz Avenue, Fort Myers. The County’s utility easement encumbers an area of approximately 800 square feet of land and is recorded at Order of Record Book 2708, Page 634, Lee County.

2. Authorize the Chair, on behalf of the Board, to execute the Subordination of Utility Easement Interests.

3. Authorize the County staff to handle and accept all documentation necessary to complete this transaction.

Subordinates utility easement interests to the Florida Department of Transportation for roadway improvements at the northwest corner of Colonial Boulevard and Ortiz Avenue, Fort Myers. The County’s utility easement encumbers an area of approximately 800 square feet of land.

The Florida Department of Transportation (FDOT) is currently designing improvements to I-75/Colonial Boulevard Interchange from West of Ortiz Avenue to East of Dynasty Drive, Project No. 413065-1-52-1. These improvements will include major modifications to this interchange which will include, in part, acquiring additional right-of-way, as well as impacts to an existing Lee County Utilities (LCU) 16-inch water main.  Lee County Utilities has requested entering into a Utility Work by Highway Contractor Agreement (UWHCA) with FDOT in order to coordinate the impacts the proposed roadway project will have on LCU’s existing water main.

The additional ROW that FDOT is acquiring includes the existing LCU Utility Easement on the Northwest corner of Ortiz Avenue and Colonial Blvd.  The portion of the existing 16-inch water main within this easement, along with other sections of the existing water main, are anticipated needing relocation as part of this major interchange improvements.
