1. Adopt a Resolution and Approve Agreement for the Exchange of Real Property between Lee County and Bristol Salamanca, LLC, for County’s interest in a drainage easement located at 6308 Panther Lane, Fort Myers, for a new perpetual stormwater drainage easement;

    

2. Authorize the Board Chair to execute an Agreement for Exchange of Real Property and a County Deed releasing the easement interest;

    

3. Authorize the Board Chair to accept a replacement Perpetual Stormwater Drainage Easement and execute and accept other documents to complete the exchange;

    

4. Authorize County Lands Staff to execute and accept all documentation necessary to complete this transaction.
   

Approves easement exchange to allow property owner to better manage their drainage system.  The exchange area is located south of Cypress Lake Drive and east of Panther Lane in South Fort Myers.  There will be no cost to the County for the requested exchange.

Lee County Department of Transportation received a request from Bristol Salamanca, LLC  (Bristol) to exchange interest in a drainage easement located on the subject property identified as STRAP Number 22-45-24-00-00001.0220, in order to accommodate installation of a fence, maintenance landscaping and drainage area.

The easement was conveyed for drainage to Lee County by Order of Taking to Lee County, recorded January 30, 1990, recorded in Official Records (O.R.) Book 2124, Page 4108, and Stipulated Final Judgment recorded in Official Records (O.R.) Book 2502, Page 122, all in the Public Records of Lee County, Florida.

Bristol has agreed to grant a new replacement perpetual stormwater drainage easement to Lee County in exchange for its interest in an existing drainage easement.

Bristol will pay all costs of the exchange. There will be no cost to the County for the requested exchange.
