TITLE:Approve Contract Amendment to the Pollution Storage Tank Inspection Program 

I.MOTION REQUESTED
 
  1. Approve amendment #2 to Florida Department of Environmental Protection (FDEP) contract  No. GC927 for the Pollution Storage Tank Compliance Inspection Program

  2. Authorize the Chairman to execute the amendment on behalf of the Board of County Commissioners

II.ITEM SUMMARY
 

Approves amendment #2 to the Florida Department of Environmental Protection contract #GC927 for the County’s Pollution Storage Tank inspection program for the remainder of the current ten year term.   The amendment is needed in order for the State to reimburse the County for travel expenses related to their annual mandatory training session for County staff.   This item is approved in the current budget.

III.BACKGROUND AND IMPLICATIONS OF ACTION

On September 30, 1992, Lee County entered into Florida Department of Environmental Regulation contract GC216 for site clean-up program activities, which is the beginning of the County Program.   On June 2, 1998, Lee County entered into a ten-year contract, DEP Contract No. GC570, with the Florida Department of Environmental Protection to perform pollutant storage tank inspections in Lee County, for the period of July 1, 1998 to June 30, 2007.    On June 6, 2007, Lee County entered into an additional ten-year contract, DEP Contract No. GC709, for Storage Tank System Compliance Verification Program for Lee County, for the period of July 1, 2007 to June 30, 2017.   On September 4, 2012, the Board approved an amendment to the FDEP agreement that added the inspection of tanks in Charlotte County.   On August 27, 2013, the Board approved an amendment to the FDEP agreement that added the inspection of tanks in Desoto County.   On June 6, 2017, the Board approved a new 10 year agreement with FDEP for the inspection program.   On June 19, 2018, the Board approved the amended and restated contract (amendment #1).

 

The current contract expires June 30, 2027.

The purpose of the Pollution Storage Tank Inspection Program is to insure all Regulated Storage Tanks are in compliance with State regulations (F.A.C. 62.761 and 62.762) for Lee, Charlotte, and Desoto counties. Other duties include closure and discharge inspections, reinspections and the investigation of complaints. FDEP subcontracts this function to Lee County and pays for the cost through this agreement.   There are currently 565 regulated facilities with 1,319 regulated storage tank systems in Lee County alone.   The contract with FDEP funds 100% of the cost of this program.

 

Amendment #2 to the agreement is needed in order for FDEP to reimburse the County for the travel costs associated with sending our technicians to their annual mandatory training session in Orlando.
