TITLE:Amend Construction Manager Services Agreement for Recycling Equipment Improvements 

I.MOTION REQUESTED
 A) Approve the First Amendment of the Construction Manager Services Agreement with Stultz, Inc., under Solicitation No. CMR180033TJM Annual Construction Management Contract, for the Recycling Facility Equipment Upgrade project at the Lee County Recycling Facility, to establish the Guaranteed Maximum Price (GMP) in the total amount not to exceed $1,728,293.05.
B) Authorize the Chair to execute the Amendment documents on behalf of the Board of County Commissioners.
C) Authorize an additional $172,829.30 (10% of the total contract amount) in contingency funds to cover unforeseen expenses that may arise during the project. Grant the County Manager, or designee, the authority to use the contingency funds, and to approve the associated Change Orders, as may be necessary to complete the project.
II.ITEM SUMMARY
 Approves an amendment to the Construction Manager Services Agreement with Stultz, Inc. for the recycling equipment upgrades to the Material Recovery Facility and establishes the Guaranteed Maximum Price (GMP), in an amount not to exceed $1,728,293.05, and allows for an additional contingency of $172,829.30 (10% of contract amount) to cover any unforeseen expenses that may arise. These upgrades will improve recovery of recyclables and better overall system performance. This project was planned for and included in the CIP budget. Construction is anticipated to begin in Spring of 2019.
III.BACKGROUND AND IMPLICATIONS OF ACTION

On March 20, 2018, the Board approved award of CMR180033TJM Annual Contract for Construction Manager at Risk to fifteen firms, including Stultz, Inc. Additionally, the Board authorized staff to negotiate, on a project-by-project basis, the percentage of the Construction Management (CM) Fee and the Guaranteed Maximum Price (GMP) and required each project with a cost of $100,000.00 or more to be brought back to the Board for approval.

Staff is requesting that the Board approve an additional $172,829.30 (10% of the total contract amount) in contingency funds to cover possible unforeseen expenses that may arise during the project.

The Scope of Services being provided by the CM consist installing new infeed equipment and expanding the presort system, and the addition of an Optical Sorter Unit. These improvements will allow for higher recovery of recyclables, directly correlating to a reduction in residue and better overall system performance.

 

Republic is the current operator of the Material Recovery Facility (MRF) and per their contract with the County, once the subject equipment are installed and operational Republic’s O&M fee is reduced by $3.50/Ton material handled.  This reduction in cost and enhanced material recovery could produce an estimated Return on Investment (ROI) of 3 to 5.5 years.
