TITLE:Approve Contract for Structural Design and Construction Improvements to Hertz Arena 

I.MOTION REQUESTED
 A) Award Design-Build Request for Proposal No. DB180403ANB, Structural Design and Construction Improvements to Hertz Arena Roof and Building, to The Walker Contracting Group, Inc., in the total not to exceed amount $3,229,751.00.
B) Authorize staff to negotiate the contract, with County Administration’s approval, for an amount not to exceed $229,751.00 for analysis and an amount not to exceed $3,000,000.00 for design and construction.
C) Authorize the Chair of the Board of County Commissioners to execute the contract documents upon receipt.
D) Approve Budget Transfers in the amount of $2,000,000.00 from All Hazards Reserves and $1,000,000.00 from General Fund Reserves to the County Wide Building Renovations Project and amend FY 18/19 budget accordingly.
II.ITEM SUMMARY
 Approve contract with The Walker Contracting Group, Inc., for structural design and construction improvements to the roof and building of Hertz Arena to strengthen and enhance the Arena’s ability to provide maximum protection against hurricane winds and provide citizens with added protection and safety in the event of an emergency. Anticipate construction will begin in March 2019 and be completed in June 2019 weather permitting. The total estimated cost of the improvements is $3,229,751.00. This project was planned.
III.BACKGROUND AND IMPLICATIONS OF ACTION
 A)Board Action and Other History
  On August 10, 1999, the Board of County Commissioners approved a lease agreement with KTB Florida Sports Arena Limited Partnership, owner of Germain Arena (then called Everblades Arena) to allow the use of the facility as a hurricane shelter and staging area for emergency response purposes. After Hurricane Irma in September 2017, the County decided that a new lease agreement was needed to reflect changed circumstances as well as the need to make improvements including roof repairs to the facility to enhance its capabilities as one of the major public shelters in Lee County.

On June 19, 2018, the Board approved a new Lease Agreement between KTB Florida Sports Arena, LLC, owner of Hertz Arena (then called Germain Arena) and Lee County to continue the availability and use of the Arena as a public shelter for hurricanes and other disaster and emergency events and replacement of the roof.

Facilities Construction and Management requested Procurement Management solicit proposals for the structural design and construction improvements of Germain (Hertz) arena roof and building. On September 8, 2018, Procurement Management advertised Design-Build Request for Proposal No. DB180403ANB, Structural Design and Construction Improvements to Germain Arena Roof and Building. On the proposal deadline, October 10, 2018, Procurement received two proposals. The first evaluation meeting was held on October 31, 2018 and both firms were short-listed to return for a secondary evaluation that included a presentation and question and answer session. The second evaluation meeting was held on November 7, 2018, after the presentations, the committee recommended the contract be awarded to The Walker Contracting Group, Inc, in a total amount not to exceed $3,229,751.00.
 B)Policy Issues
  The Board has voted in the past to authorize the Chairman to act on behalf of the Board in the best interest of the County to avoid delays of construction projects to keep them on schedule.
 C)BoCC Goals
  Lee County is vulnerable to tropical weather events and plans year-round with multiple agencies on how to safely shelter residents and visitors during storms like Hurricane Irma. Southwest Florida has an above normal storm surge risk, which limits the facilities that can serve as hurricane shelters. In a worst-case scenario, Hertz Arena provides Lee County with over 5,000 additional shelter spaces, greatly increasing our shelter capacity and providing for the safety of those seeking shelter.
 D)Analysis
  Under the current lease agreement, the County and the owner of the Germain (Hertz) Arena agreed to undertake certain improvements to the roof of the specified shelter area of the Arena with the goal of strengthening and enhancing the Arena’s ability to provide maximum protection against hurricanes and other storm events and providing citizens with added protection and safety in the event of an emergency. The improvements to the Arena include design and repairs to the roof and other necessary measures to withstand hurricane winds. Subject to available funding and appropriations, the County is responsible for design, procurement, funding and construction of the new roof with the Owner’s participation and cooperation throughout the separate phases of the project. In consideration for the County’s promise to design, procure, fund and construct the new roof, the Owner agreed to a 30- year lease term.
